These General Conditions apply to all orders of the products put up for sale on the site www.shop.inspire-vapestore.com

Important information : online sales of vaping products is now prohibited in the Netherlands and Belgium. Therefore, we no longer expressed packages to these two countries. Any attempt to order with a delivery address in another country, followed by a request for redirection to Belgium or the Netherlands, will lead to the cancellation and reimbursement of the order. Thank you for your understanding.

 

Article 1 - Ability to contract

By purchasing through this site, the buyer acknowledges being of age and being authorized by the regulations of his country of residence to order on our site the products he commands. The Elysium company declines any responsibility in this regard.

Article 2 - Confidentiality

www.inspire-vapestore.com will not have access to your bank data at any time. Transactions are fully carried out on secure banking platform. www.inspire-vapestore.com will be the only holder of personal information communicated by the buyer. They will not be transmitted to a third party except in the context of external services necessary for the proper realization of our activity (bank provider for online payment, carrier for the delivery of packages, customer notice manager, etc.). These providers are forced by contractual obligations to comply with confidentiality and data protection and to process them only for the purposes for which we send them. Article 3 - accuracy of the contact details

3.1 Delivery address

It is customer responsibility to indicate a correct delivery address. www.inspire-vapestore.com may not be held responsible for a delay or an unvilled package resulting from an error in the address indicated by the customer. If returning costs are applied by the carrier in the event of a return from the parcel to the sender because of a non -valid address, these costs will be borne by the customer. If the buyer requests a second shipment to the address which has been previously corrected by the latter, the costs will be responsible.

3.2 Telephone number and email address

It is important that we can contact you quickly in the event of a problem with the order or with the products that have been ordered. It is the customer's responsibility to indicate, when ordering, reliable contact details on which we can contact you quickly. www.inspire-vapestore.com cannot be held responsible for a problem or information that would not be, or would have reached the customer late due to the erroneous or unreliable contact details provided by the customer.

Article 4 - Delivery restrictions and regulatory compliance

The buyer undertakes to comply with the regulations in force in his country of residence concerning the purchase and delivery of the products ordered on our site www.inspire-vapestore.com.

 

Online sale and purchase are now prohibited in Belgium and the Netherlands, making the creation of delivery addresses in these unauthorized countries.

 

All orders made on our site are intended for delivery in countries where it is legally possible to order these products. We ask our customers to ensure that the delivery address indicated when ordering is in accordance with applicable laws, without further intention to reach countries where online sales of our products can be restricted or prohibited. It is the full responsibility of the buyer. In the event of proven or suspected non-compliance with the delivery address with the restrictions set out, www.inspire-vapestore.com will cancel the order. This cancellation will lead to the partial retention of the sums already paid, intended to cover the administrative and preparatory expenses incurred to this point.

Article 5 - Products

The products are presented on our website as faithfully as possible. However, the photographs reproduced online are only indicative illustrations. We invite the customer to refer to the description of each product in order to know the characteristics. We reserve the right to add new products, delete all or part of the products sold or presented on the site, to change their presentation or to stop their marketing.

Article 6 - Price

Our prices are denominated in euros, taxes and costs included. Our prices do not include transport costs (article 7). The transport costs are indicated in the "basket", accessible at any time, as well as on the order page, before making the order of the order.

Article 7 - Order and payment

Full payment of the order conditions the shipment of products, to the extent of available stocks. Payment will be made a banking platform (VIVAWALLET, PAYPAL or your own bank account in the event of payment by transfer). At no time will www.inspire-vapestore.com have access to your banking data.

Article 8 - Terms, deadlines and delivery costs

Our delivery obligation is fulfilled at the registered office of the Elysium company, 16 RES La Petite Mare du Bout, 50470 Cherbourg en Cotentin which is the place of execution of the purchase agreement. By ordering, the customer mandates us to charge a carrier to send the goods to the address he will indicate in the order form. The delivery time varies for each order, depending on the choice of the delivery method for which the buyer will mandate to us when ordering. There are three delivery methods at the customer's choice (standard delivery, secure delivery and Saturday Delivery (delivery on Saturday). The delivery costs are a function of the weight of the package and include packaging, handling and costs inherent in sending the package. The customer is responsible for someone to receive the package at the address indicated.

Article 9 - Complaints

The customer is required to check his package upon receipt. If he were to note damage and express reservations on the products, the Customer must do so clearly and precisely with the person who gives him his package and notify these reservations by mail or email within 3 days of receiving the package.

Article 10 - Right of withdrawal

The Customer has the right to withdraw from the contract concluded without giving a reason within 14 days. To exercise the right of withdrawal, the customer must notify us at the latest within 14 days of receipt of the goods his decision to withdraw from the contract by email at the address services@inspire-vapestore.com. The customer will take care to specify in the notification his number of the order which he retracts and the bank account number to which he wishes to be reimbursed. The customer must send us back or return the property (s) no later than 14 days after having communicated his decision to withdraw to us. The return costs are fully charged to the customer. In the event of withdrawal, we will reimburse the goods including the delivery costs within 14 days of the return of the goods. To be able to benefit from the reimbursement of the goods ordered, the products must have been returned intact, in their original packaging. Products and packaging must not have undergone any alteration. All the products that have been delivered must be returned to us, including boxes, notices, and various documentation.

Article 11: Commercial warranty

You must inform us by phone of the defect noted before sending the equipment

Guarantee :

• Batteries, accumulation, boxes, chargers and adapters: 3 months
• Clearomizers: 1 month

The warranty does not cover the faults due:

• To use not in accordance with the use for which the product is intended
• Has an external cause (repair carried out by a third party, accident, disassembly of the system)
• In compliance with the instructions for use and maintenance indicated in the notices

Article 12 - Guarantee of consumer goods

We will respond to any lack of conformity that would exist during the issuance of the property and which would appear within two years from it. However, the defect will be deemed to be non -existent if at the time of the conclusion of the contract, the consumer knew this defect or could not reasonably ignore it or if the lack of conformity is attributable to him. It is agreed that the consumer will have to notify us of any lack of conformity, in writing, in a short time from the day he noted the defect. Failure to comply with this obligation will result in the loss of consumer rights. Any return of goods within the framework of the guarantee must be accompanied by the order number which the customer retracts and the bank account number to which he wishes to be reimbursed. The products must be returned in good condition in their original packaging with any accessories and notices. The legal compliance guarantee applies independently of the commercial guarantee.

Article 13 - Force majeure

We are not responsible for the non -performance of any of our obligations when this non -performance is due to a case of force majeure, in particular in the event of fire, hail, natural disaster, strikes, general lack of supply or means of transport, etc.

Article 14 - Reserve of property

The products sold remain our property until full payment of the price.

Article 15 - Responsibility

15.1 Responsibility and improper use

The seller cannot be held liable for damage of any kind, both material and admits or bodily, which may result from improper use of the marketed products. It is the responsibility of the buyer to strictly monitor the instructions provided by the seller and/or the manufacturer concerning the correct and secure use of the products. This responsibility includes, without limiting itself, compliance with safety warnings, assembly, use, maintenance, and product storage instructions.

15.2 Exclusion of responsibility

The buyer expressly recognizes that any use of the products sold which would not be in accordance with the instructions provided, or any modification or alteration of the products, excludes the seller's responsibility for any damages that result from it. This exclusion of responsibility covers the cases where the damage results from the neglect of the buyer, from inappropriate use, abuse, alteration, modification, inadequate maintenance, as well as any accidental damage or resulting from an external cause.

15.3 Indirect damage

Are expressly excluded from the seller's responsibility, without this list being exhaustive, any indirect damage such as, but not limited to, loss of profits, data, opportunities, customers, as well as any other financial loss or commercial disturbance arising from the use or impossibility of using the products sold.

15.4 Ceiling of compensation

In any event, if the seller's responsibility should be engaged, the amount of damages to the seller's office cannot exceed the amount paid by the buyer for the purchase of the product concerned.

15.5 Force majeure

The seller will not be held responsible for the total or partial non-execution of his obligations, if this non-execution is due either to a third party, or to a case of force majeure as defined by the case law of the French courts, including but without limiting himself, natural disasters, strikes, fires, floods, failure or failure of the computer system, interruption of telecommunications or any other circumstance escaping reasonable control of the seller.

15.6 Reachment to prohibited countries

The seller declines any responsibility for orders reacted to countries where the online sales of the products sold is prohibited. ARTICLE 17 - Applicable dispute and law

We count on the good will of each party in order to resolve a conflict that would arise between www.inspire-vapestore.com and the buyer. This agreement is governed by French law, except other imperative provisions.

Article 18 - Competent jurisdictions

Without prejudice to the legal provisions applicable in the event of a contract with a consumer, any dispute relating directly or indirectly to this agreement will be the exclusive jurisdiction of the courts of the Judicial district of Cherbourg (50100), France.
